Abstract:
اتفق العلماء على أنّ لله سبحانه أحکاماً مشترکة بین العالم والجاهل والمؤمن والکافر. ثمّ إنّ المشهور تفسیر الحکم المشترک بوجود خطابات کثیرة حسب عدد المکلّفین، فالخطاب الواحد عندهم ینحلّ إلى خطابات لکلّ مکلّف عبر الزمان. و اما سیدنا الأُستاذ الإمام الخمینی1 أبدى نظراً خاصّاً و هو أنّ خطابات الشارع فی الکتاب والسنّة خطابات قانونیة، فالخطاب واحد وإن کان المخاطب متعدّداً، لکن الخطاب الواحد بوحده حجّة على کلّ مکلّف کان مصداقاً للعنوان، من دون حاجة إلى تعدّد الخطاب.
هذه الرسالة دراسة بإمعان ودقّة لتطویر تلک النظریة وتکامله
It is consensus between scholars that the rulings of the Lawgiver (ash-Shari‘) is common between knower and ignorant and between believer and unbeliever. Then it is putative Interpretation that those common rulings are plural articulations (khetab) in the number of legal agents (mukallaf). Therefore in this view, the single articulate is divided into articulates for every legal agent over time.
Based on the theory of our great teacher Imam Khomeini, articulations of the Lawgiver (ash-Shari‘) in the Quran and sunnah are Legal Articulations. Then although the legal agents are plural, but the articulation is single, and this singular articulation is probative for all of the legal agents, no need to the plural articulations.
This article is going to discuss the theory of Legal Articulations and its development in briefly.
